WHY YOU SHOULD CONTACT US AS SOON AS POSSIBLE

Your case should be resolved within one month, or at the latest, within two months. The sooner you contact us, the sooner we can start working on your case. Even if you have been told that your case will be processed within four months, please be aware that the authority will most likely extend this period, often without informing you. The Pomorskie Voivodeship Office in Gdańsk frequently fails to notify applicants of the extension of their case processing time, which constitutes a serious violation of administrative law.

If you contact us a month after submitting your application, we will immediately urge the Office to process your case. In this way, you could obtain your residence permit up to a year sooner.

Not many people know that you have the right to review your administrative case files initiated by submitting, for example, a temporary residence permit application. You can also obtain copies of these files and photograph them. By reviewing your case files, we can see how the Office has handled your case and what actions have been taken.

These files should be made available to you immediately. However, it is often very difficult to get through to the Office to schedule a file review appointment. Some Offices also schedule appointments far in advance, violating the principle of active participation of the party (you) in the administrative proceedings.

By reviewing your case files, we can determine what documents need to be submitted to expedite the process. For instance, during the months-long wait, your insurance policy might expire. You could wait several more months just to be formally asked to provide the updated document. We can find out what documents are needed much faster. We can also check if the necessary inquiries have been made to the Police, Border Guard, and Internal Security Agency regarding your case. These agencies must verify and inform the Voivode if there are any reasons to object to your stay in Poland. They have one month for standard cases and two months for more complicated ones.

HOW MUCH DOES IT COST AND WHAT CAN YOU GAIN?

The procedure to accelerate the issuance of a residence permit decision in Poland is not associated with significant costs.

Filing a formal complaint to the Head of the Office for Foreigners is free of charge, except for a 17.00 PLN fee for the attorney’s power of attorney.

The fee for filing a complaint to the Voivodeship Administrative Court is 100.00 PLN. These are very small amounts considering that:

  • We can speed up the issuance of your decision by several months, and if you contact us early – even by a year,
  • The Court may award you compensation of several thousand PLN for the prolonged processing of your case.

Of course, the attorney’s fees are a separate matter, which we always discuss individually with the client, considering their financial capacity and the complexity of the case. We always offer the possibility of paying our law firm’s fees in installments.
