Terms and Conditions of the Online Store

§ 1

General Provisions

These Terms and Conditions (hereinafter referred to as the “Terms”) define the rights and obligations related to the use of the website www.pobytwpolsce.pl (hereinafter also referred to as the “Website”), in particular the rights and obligations of Users related to the purchase of digital content online (hereinafter
referred to as the “Product”). The sale of Products is offered by Maja Gidian conducting business under the name Kancelaria Adwokacka Maja Gidian, ul. Starowiejska 26/3, 81-366 Gdynia, NIP: 534-234-54-08, REGON: 365225160, e-mail: kancelaria@adwokatgdynia.pl, bank account number: 67 1140 2004 0000 3402 7702 6596, hereinafter referred to as the “Seller”.

Contact with the Seller is possible by traditional or electronic mail at the addresses indicated above, as well as by telephone: (58) 380-81-08.

To properly use the Products or services offered through the Website, the following are required: Internet access, a device capable of using the Internet, an updated web browser, an active e-mail account, and software/apps enabling the reading of files in pdf, docx or doc format, such as Adobe Acrobat, MS Office, Open Office, or other programs.

The Buyer may be a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality, which is granted legal capacity by law, making purchases on the terms specified in these Terms. The Buyer may be a Consumer within the meaning of Article 22¹ of the Civil Code of 23 April 1964, as amended, or a natural person concluding a contract directly related to their business activity, provided that it does not have a professional nature for that person (so-called entrepreneur with consumer rights).

§ 2

Products and Terms of Order Placement

Orders are placed via the Store, where the Buyer can choose Products based on their descriptions.
Products are digital goods (forms and templates). The Buyer acknowledges that:
a) the Product includes only a template, which may not be suitable for their individual case – in such instances, consultation is recommended before use;

b) the Product is up-to-date according to the legal status on the date of availability, as indicated in the description;
c) the Product does not include any additional services such as free legal advice or consultations.
To complete the order, basic information must be provided: full name, address, e-mail, phone number; for non-consumer Buyers: company name, address, and tax ID (NIP). Detailed information regarding data processing can be found in the Privacy Policy on www.pobytwpolsce.pl

Acceptance of these Terms is required to place an order.
Once an order is placed, the Buyer will receive an order confirmation via e-mail. The contract is concluded upon payment.

The Seller charges in advance. Prices are quoted in PLN and are gross amounts.
The Seller may change prices, introduce new Products, promotional packages, or withdraw Products.
Payments are made by electronic transfer via a Payment Operator.
The Product will be sent to the e-mail provided by the Buyer within 2 business days after payment is received.

§ 3

Licence

The Seller grants the Buyer a non-exclusive, non-transferable, and territorially unlimited license to use the Product (hereinafter the “License”). The License does not permit sublicensing.

The License allows personal use only. Commercial use is prohibited unless explicitly stated otherwise. Resale or redistribution is not allowed.

Products and content may not be copied or distributed in any form, except for personal use under the License. The Buyer may save, open, modify for intended use, and print the Product.

The License fee is included in the Product price.

§ 4

Withdrawal from the Agreement

  1. The right to withdraw from a distance contract does not apply in the following cases:
    a) where the service has been fully performed with the Buyer’s explicit consent, having been informed of the loss of the right of withdrawal after the service is rendered;
    b) where the contract concerns the supply of digital content not supplied on a tangible medium and performance has begun with the Buyer’s consent before the withdrawal period expired, after being informed of the loss of the right to withdraw –in accordance with Article 38 point
    13 of the Consumer Rights Act of 30 May 2014.
  2. By accepting these Terms and placing an order, the Buyer agrees to receive the Product before the expiration of the withdrawal period and acknowledges losing the right to withdraw.

§ 5

Complaints

The Seller is obliged to deliver a Product free from physical and legal defects.
Complaints will be processed within 14 calendar days. The complaint should include the complainant’s details, reason for the complaint, and requested outcome. The Buyer must send the defective product along with a description of the issue.

Responses to complaints will be sent to the Buyer’s e-mail address.

For non-consumer Buyers, the Seller’s liability under warranty is excluded.

To the fullest extent permitted by law, liability for damages is limited to the amount paid for the Product.

§ 6

Final Provisions

In case of changes to the Terms, Buyers will be notified via the Website and asked to accept the new version.

Polish law applies to all contracts concluded through the Website.

Product information on the Website constitutes an invitation to conclude an agreement under Article 71 of the Civil Code.

In the event of a dispute, Buyers may use alternative dispute resolution methods, such as mediation or arbitration provided by the relevant regional Consumer Inspectorate.

If any provision of these Terms proves to be invalid, the remaining provisions remain effective.
